1. Legal Disclaimer & Limitation of Liability
KinderCare ("the Company," "we," "us," or "our") operates solely as an online marketplace and referral platform that connects families ("Clients") with independent childcare providers ("Sitters"). All Sitters listed on this platform are independent contractors and are not employees, agents, partners, joint venturers, or representatives of the Company in any capacity.
2. Acceptance of Terms
By accessing or using the KinderCare platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use the platform. We reserve the right to modify these terms at any time, and your continued use of the platform constitutes acceptance of those changes.
3. Eligibility and Accounts
You must be at least 18 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process.
4. Background Checks & Safety Screening
While KinderCare facilitates background checks through third-party providers (e.g., Checkr), we do not guarantee the accuracy or completeness of these reports. Families are solely responsible for interviewing, performing additional due diligence, and making final hiring decisions.
KinderCare is not responsible for the conduct, whether online or offline, of any user of the platform.
5. Subscriptions and Payments
Access to certain platform features requires a paid subscription. Subscriptions are billed in advance on a recurring basis (monthly or annually) depending on the plan selected. You may cancel your subscription at any time; however, no refunds will be provided for any remaining portion of a subscription period.
6. Codes of Conduct
Users agree to treat all members of the KinderCare community with respect. Prohibited behavior includes, but is not limited to: harassment, discrimination, fraud, sharing of illegal content, or attempting to circumvent the platform's payment systems.
7. Virtual Interviews
For the safety of our community, KinderCare requires a mandatory 15-minute virtual interview via our integrated Zoom tools before an in-person booking is confirmed. Failure to comply with this safety protocol may result in account suspension.
8. Limitation of Liability
To the maximum extent permitted by law, KinderCare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the platform or the services provided by independent contractors.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
